Spread of Sunni Islam in the Black Community Alarmed Afrocentrics and Missionaries.
by Kaukab Siddique, PhD
After Malcolm X [al-Hajj Malik Shabazz], Sunni Islam spread
in America, first slowly and then like a landslide.
Outstanding Sunni leaders like Imam Jamil Abdullah al-Amin
and Dr. Abdulalim Shabazz befriended me and helped me to see
the real situation. I also learned from activists like Imam
Khalil Abdur Rahman and Br. Mauri Saalakhan though I
sometimes differed with them. Over the years I married hard
core Sunni Black women.
Finally I visited Africa, including Nigeria and Ghana. My
step son was in Sudan for a long time. I visited numerous
Sunni Black prisoners in the US prison system. It was a
learning process and helped me to realize that immigrant
Muslims and White people know little or nothing about Black
Sunni Muslims.
Today there are mosques following mainstream Sunni Islam
right across America in Black communities. The Black
churches and Christian communities started losing chunks of
their congregations
to mainstream Islam. They were alarmed and with the help of
Afrocentrics they launched what they thought would be deadly
attacks on Islam. They focused on issues which they thought
would be most effective. The most important would be:
The claim that Islam supports slavery and the "slave
trade" in Africa was as bad as the one which brought slavery
to America. They claimed that glorious African empires were
decimated by the Muslims who took up the slave trade.
The claim that "Arabs" brought Islam to Africa and helped
to destroy African culture and civilization.
In those areas of Africa where Islam was the strongest, my
travels showed that one could travel a thousand miles
without meeting an "Arab".
However, the Afrocentric assault was difficult to answer
because they were so friendly and so sympathetic to Africa
that they deluded me. Now there has been a devastating
response from a scholar originating in Ghana who has
destroyed the Afrocentric propaganda. [I was able to get
this rare book from Br. Kwame Madden in Peekskill, a little
town north of New York where I once gave a speech.]
The book is titled Defining Legends:An Analysis of
Afrocentric Writings Against Islam. The author of this 385
page book is Abdul Haq al-Ashanti. It is packed with
invaluable information, well documented and with a fine
bibliography.
Al-Ashanti notes that the root idea of the conquest of West
Africa by the Almoravids came from Leo Africanus, a Moroccan
baptized as a Christian in the servitude of the Pope. He
wrote a book in 1550 in Italian which became a textbook for
Europeans thinking about Africa over 400 years.
He had no evidence about Africa and he described the
Africans in terms which Europeans still use about West
Africa because it was translated into French, Latin, English
and then into Dutch and German. On page 50 al-Ashanti
writes:
"Leo Africanus claimed that the 'Land of the Blacks' was not
necessarily 'conquered' but rather overpowered in 380 CE and
that it was a land 'inhabited by people who lived like
brutes, without kings, lords, republics, government and any
customs and without knowing husbandry.' "
He was not able to provide any evidence and had no knowledge
of the Almoravides or even of hid birthplace, Morocco.
The writings of Ahmad Baba of Timbucti which detailed the
descriptions of Africa and voluntary conversions to Islam
were unknown to the Europeans for 300 years.
Al-Ashanti writes about all the well known European writers
and notes their views are "remarkably similar to that of the
Afrocentrics and black Orientalists not only in the
description but also in the utter lack of proof and sources.
Mungo Park also copied more or less word-for-word from Leo
Africanus too, blindly accepting Leo's account as fact....."

Islamic Women Teachers arrested and beaten up.
Sis. Nadrat, confirmed by reports from Pakistan, indicates that Asma,
the daughter of Maulana Abdul
Aziz, was arrested and mistreated by Pakistani security
forces on February 9.
Other female teachers at the Lal Masjid [Red Mosque] have
also been arrested.
Sis. Nadrat reports that a twitter storm has been launched
by people protesting the arrests. The impact of the protests
on Pakistani police indicates that the Islamic women will be
released soon.
Direct reporting from Pakistan indicates that the regime and
secularists keep harassing the hijabi women almost every
month to pressure the elderly leader Maulana Abdul Aziz who
openly opposes the anti-Islam and anti-mujahideen policies
of the regime.
[New Trend condemns the police activity against the Red
Mosque. Most shameful is the arrest of Asma, the Maulana's
daughter, and other female teachers.]
Dr. Pervez Hoodbhoy's satanic Activities Caught.
Anti-Pakistan Elements are allowed to Flourish.
Journalist Tariq Ismail Sagar released a video from his
Canadian representative Tariq Naseem dated February 9, 2021
about a presentation made by Pakistani scientist Dr. Pervez
Hoodhbhoy who was visitingToronto University.
It was supposed to be about the plight of Kashmir but the
audience were amazed to see that Hoodbhoy was projecting a
fake video of atrocities in Kashmir as if Pakistan is
carrying out those crimes.
He also tried to insult the founder of Pakistan's nuclear
program Dr. Abdul Qadeer. He expressed his hatred of
Madrasas [Islamic schools] as well [which support many
orphans and homeless children].
Many Indians, including Hindus, were in the audience and
they heartily cheered Hoodbhoy. When he came out of the
presentation, he received a great welcome from Indians.
Tariq Sagar is amazed that Pakistan allows such extreme
anti-Pakistan elements not only to flourish but to lead
scientific academies.
Sagar also mentions an abusive anti-Islam person named Tarek
Fatah who is said to be Canadian-Pakistani who openly
attacks the Islamic origins of Pakistan and supports LGBTQ.
The anti-Islam Canadian media love him.
Sagar also mentions a third person named Tahir Gora who
actually set up a fake "Islamic" publishing house in
Pakistan which openly attacked Islam. On being discovered,
he fled to Canada. Now he regularly broadcasts propaganda
from Canada of India's racist Hindu organization known as
the RSS.
Sagar has done a good job of uncovering these hate mongers.
He now has more than 86000 subscribers.
It is strange that the Pakistani government allows these
haters to take over key positions and to attack Islam which
is the basis of Pakistan.
Instead the government is busy suppressing Islamic forces to
please USA, India and Israel.

Islamic Move to Protect Women's Rights
by Qaiser Sharif
LAHORE- FEB 11: Jamaat-e-Islami Emir Senator Sirajul Haq has
demanded complete ban on dowry and other un-Islamic and
anti-constitutional traditions in society and also called
for ensuring protection of women at work places and
educational institutions.
While talking to journalists on occasion of launching
"Istehkam-e-Khandan- Protection of Family Institution"
campaign at Mansoora on Thursday, he said the practices of
displaying dowry articles and its demand from the groom
family, depriving women from inheritance, "marriage" of a
woman with Quran, honor killing, wani and others were still
intact in the society despite legislation against them.
"Islam strictly prohibits these corrupt practices. The JI
has decided to thwart the attacks on Islamic society."
The Istehkam Khandan campaign would continue for a month-
Feb 11 to March 11. Rallies and conferences will be
organized during the campaign to create awareness among the
public about how the planned attacks are being launched to
destroy sanctity of the institution of family and how to
cope with the challenge. The JI would mark February 14 as
Youm-e-Haya [Day of Modesty] and also JI women's wing has
decided to hold marches in all major cities on International
Women's Day on March 8 with the demands from the government
to implement Article 35 and 37G of the constitution
providing protection to women.
Answering questions from the journalists, he said video
scandal of the members of the assembly posed a bigger
question that how an elected member could protect the rights
of the people who offered his loyalties against money. This
was the biggest tragedy that horse-trading has become a
common culture in the country, he said; the PTI failed to
curb the practices which continued in the past too.
He demanded the government fulfill the promises it made with
the youth and women for providing them interest free loans
and jobs. He said every man and woman in the country was
worried due to the rampant inflation. He said the JI would
hold rallies in Faisalabad, Multan, Bahawalpur and other
cities against the anti-people policies of the PTI government.

On February 12, in South Waziristan, 4 Pakistani troops were
killed in a gunfight with an Islamic group.
Several days earlier, in North Waziristan, 2 Pakistani
troops were killed and several wounded.
[NT comment: The army never shows pictures of the fighters
it claims to have killed. That would shed light on the fact
that the army is fighting Islamic people who are Pakistanis.
Also the army uses the term picked up from Israel that it is
fighting "terrorists."
It is ridiculous to claim that those on the battlefield are
terrorists! The northern areas which the army has occupied
are the lands of mosques and madrasas.
The army calls its dead "martyrs" although the army is certainly not
fighting for Islam. Its efforts against India are almost zero on the Kashmir front.]

Invitation to Think
Medical Malpractice: It can happen to you.
by Sis. Aisha
[Jamaat al-Muslimeen, New York]
New York City - If you take a medical examination and the
doctor does not call you back with the results then, it is
usually assumed that the results were good. It is common for
a doctor to tell a patient not to worry if they never
receive a call from the doctor's office about any results.
Well, that is not true!
Always call the doctor back for updates on test results of any kind.
A female family member just had major surgery to remove her
cervix. She had a dilation and curettage (D&C) procedure
done, back in early 2020, to remove precancerous cells. She
went back to her doctor to take a follow-up test to be sure
that all the precancerous cells were removed. However, the
doctor never called her with those results.
After a few months of hearing nothing, she got curious and
called her doctor to see if anything was wrong. The doctor
told her that the precancerous cells came back! When the
doctor was asked why she did not call about the results she
claimed that she did not like being the bearer of bad news!
My recommendation was for her to give a bad review to warn
other patients about this doctor and to file a complaint
with the medical review board. This doctor's behavior was
not only inexcusable but dangerous!
Another routine procedure is the removal of the uterus
(hysterectomy). Gynecologists tell patients that the uterus
is useless when a woman's childbearing years are over.
However, medical experts have stated that the uterus
continues to provide necessary hormones to the woman's body
long after her childbearing years. The only time the uterus
should be removed is when cancer is present.
Medical insurance companies are the biggest culprits in
questionable medical practices.
Myomas are benign tumors found in the uterus that can grow
back after being surgically removed. Doctors who specialize
in treating myomas, without the use of unnecessary
hysterectomies, have been penalized by being excluded from
insurance plans. A hysterectomy is very expensive but, it is
only performed once whereas the removal of benign tumors may
need to be performed multiple times, costing the insurance
companies money. Some patients have been forced to pay out
of pocket for these excellent specialists because insurance
companies do not agree with their philosophies.
Insurance companies may play a role in the high maternal
mortality rates in the United States. Perhaps the reason why
the mortality rate is so high among industrialized nations
is that mothers are forced to leave the hospital after only
two days. Many of these mothers are supplied with a large
number of powerful pain killers. My mother delivered four
children through natural childbirth at a time when mothers
stayed in the hospital for a week. If any complications
developed, the doctors were there to handle the issue.
Now that Coronavirus is among us, it is more important than
ever for us to take control of our health. It is more
important more than ever to question your doctor's
suggestions. If the doctor becomes offended after being
questioned then, you may need to change doctors. Doctors are
supposed to educate their patients and I cannot trust an
educator who does not like being asked questions.
China
"Teach them not to Practice Islam."
[Excerpted from "Democracy Now!"]
Moving forward into the present, as this camp system has
been built out as a way of targeting and really transforming
the population, who they feel like, in order to integrate
them, they need to retrain them, to teach them not to
practice Islam and to speak Chinese, that program has now
been accompanied by a factory regime, that takes advantage
of the industrial-scale agriculture that's been developed,
along with the settlement of southern Xinjiang, and begins
to produce textiles for the world. Twenty-five percent or so
of cotton comes from China. So it means that it's very
difficult to buy products that don't have this cotton in
them. Sometimes it's just simply grown in the region, and
other times it's now actually being — the final
product is being produced in the region.
The factories themselves are associated with the camps, or,
in some cases, they're nearby the camps. The workers that
are sent into these spaces have no choice but to go. If they
refuse, they're labeled extremists and then can be sent to
the camps. And so, the threat of camp is really holding
people in place, along with all of the surveillance systems
that are also monitoring all of their movements.
AMY GOODMAN: Professor Byler, you wrote a piece in The
Guardian headlined "Why are US companies buying tech from
Chinese firms that spy on Muslims?" Can you name the
companies that are involved?
DARREN BYLER: I can't name all of them. There's around 1,400
firms that are working in Xinjiang to build a kind of
digital enclosure system. They're doing different —
they have different tasks within that system. But I'll name
a few.
The largest companies in China, what they call the AI
champions, national champions, are deeply invested in this
situation. They're the camera companies, the software
companies. Hikvision and Dahua are two of the largest camera
manufacturers in the world. And the op-ed you mentioned
talks about one of them, how Amazon and IBM were buying
these cameras from one of these companies in order to begin
to track coronavirus here in the U.S.
Other companies, like SenseTime, Megvii, Yitu, who are sort
of these artificial intelligence companies and also now
sometimes building cameras, are also involved in this
situation. And they're making component parts of things you
might buy, many of them made in China. So, for instance,
Megvii is also partnered with a cellphone company to do the
face recognition camera or phone access system — you
know, how you can scan your face, and then it opens the
phone for you.
So, there's lots of applications that come out of the
surveillance systems that are built in Xinjiang and then
become these other products in other locations. And so, we
have to be really careful, if we want to be ethical
consumers, in being sure that the companies we are buying
things from are not also participating in this sort of
genocidal violence in northwest China.
NERMEEN SHAIKH: Abduweli, you are working on writing a
memoir of your time in prison. Could you tell us a little
bit about that? You know, what is it that you document about
your experience in the prisons — what conditions were
like there, whether you were able to speak to other
prisoners while you were there, and what you witnessed and
learned about what had been happening and what continues to
happen in these camps?
ABDUWELI AYUP: Yes, I almost finished my book, Prisons Made
in China. And because I stayed in a Kashgar detention
center, and then in Ürümqi, three different detention
centers, so I'm very familiar with those detention center
and detention system. And in my book, I talked about what
kind of torture in interrogation room. Second is what was
happening in the cell. And the third is what's the torturing
methods in the cell and what's the guards' method to force
prisoners to confess and how the system work in a detention
center. And I describe as like a prisoner's perspective, and
I describe it from the beginning to the end, that 15 months.
And especially I focus on the guards and the prisoners'
relationship, and the guards in the interrogation. For
example, I can make you one example, that, like, guards
there, they help the interrogation, because there's a
competition between the interrogators and the guards. And if
the guard get that confess, he will be promoted. If the
interrogator get the confess, that one, like, have a
promotion more. In that case, two kind of guys are competing
to force prisoners to confess. And in my book, I describe
this — for example, that, like, prison guards, they
use hashish, and they use heroin, and they use sexual abuse
to confess, force prisoners confess, to tell what they want,
because in detention system, the guards and the
interrogators, they're mainly focused on confession, because
they want the people who are living there to tell that "We
are criminals. We are sick. And we are problem makers." They
want that answer. They don't want any detail. They want
— yes, they force the people to answer the question
yes or no. The story is already made up. Only the, like,
game is playing there is yes or no.
AMY GOODMAN: Abduweli, if you can tell us how you ultimately
left Xinjiang, how you got out of the country — we're
talking to you in Norway now — what has happened to
your family, and how they use cellphones, integral to
monitoring everything people do, gathering information from
those phones, requiring that you have them?
ABDUWELI AYUP: Yes. After I was released from the camp, I
faced a big problem that I have to keep my cellphone on, 24
hours. And if I visit my friend, and because we are together
and I was already blacklisted, and my friend become
blacklisted person. In that case, my friend was in danger.
So, I lived in that surveillance system, and it's not
possible to me to live further. That's why I faced escape. I
escaped the country because of this, because of the surveillance.
NERMEEN SHAIKH: An, Abduweli, in addition to the
surveillance that's carried out on Uyghurs in China, there
have been reports that the Chinese government is also
tracking Uyghurs living outside. Are you concerned about
your own safety? And do you still have family in Xinjiang or
anywhere else in China?
ABDUWELI AYUP: Yes, yes. Still, we are in the free world,
but we are under the pressure. For example, I went to
Chinese Embassy in 2016 September. At the time, the Chinese
Embassy in Ankara asked me to add WeChat, to download WeChat
and add them. After that, the Chinese state security in
Ürümqi called me immediately: "We are here watching you. And
what are you doing and what are you working on, we know
clearly. So you should listen to us. We'll reach you
wherever you are." It's a psychological pressure. It's only
me. Like, I'm living in Bergen right now. And I know we have
around 200 Uyghurs are, and about 20 Uyghurs called by
Chinese Embassy in Oslo. So, we are in the free world, but
we are under pressure right now.
AMY GOODMAN: Abduweli Ayup, we want to thank you so much for
joining us on Democracy Now!, telling your own life
experience, Uyghur linguist who set up a kindergarten and
ultimately was imprisoned for 15 months, also a poet. Thanks
so much for being with us, Darren Byler, anthropologist at
the University of Colorado Boulder, speaking to us from
Seattle, Washington.

Bilal [r.a.] is one of the
Best known of the galaxy of 'Sahabah'
as 'Muezzin' of the Prophet Muhammad ﷺ~ 'Masjid'
He was an Abyssinian slave of a disbeliever in Mecca.
His conversion to Islam was, naturally, not liked by his
master and he was, therefore, persecuted mercilessly.
Umayah bin Khalaf, who was the worst enemy of Islam, would
make him lie down on the burning sand at midday and
would place a heavy stone on his breast, so that he
could
not even move a limb he would then say to him...
'Renounce Islam or swelter and die.'
Even under these afflictions, Bilal (Radhiyallaho Anhu) would
exclaim... 'Ahad' The One Allah! 'Ahad' The One Allah!
he was whipped at night and with the cuts thus received, made to
lie on the burning ground during the day to make him either
forsake Islam or to die a lingering death from wounds
{!}
The torturers would get tired and take turns...
Abu Jahl, Umayah and others and would vie with one another in
afflicting more and more painful punishments but Bilal
(Radhiyallaho Anhu) would not yield {!} {'Subhan Allah'}
At last Abu Bakr (Radhiyallaho Anhu) bought Bilal's (R.A.)
freedom, and he became a free Muslim...!
As Islam taught implicitly the oneness of the Almighty Creator,
while the idolaters of Mecca believed in many gods and
goddesses with minor godlings,
therefore Bilal (Radhiyallaho Anhu) repeated...
'Ahad (The One), Ahad (The One).'
This shows his love and devotion to Allah.
Allah was so dear to him that no amount of persecution could
distract him from reciting His Holy name.
It is said that the urchins of Mecca would drag him in the
streets, with his words 'Ahad' 'Ahad ' ringing in their wake.
Look how Allah rewarded his steadfastness...! he was to have
the honor of becoming the PROPHET ﷺ~ Muezzin he was
always to remain with him at home and abroad
to call out the Azan for his 'Salat'.
After the Prophet's (peace be upon him) death it became very
hard for him to continue his stay in Madinah where he would
miss him at every step and in every corner...
he therefore left Madinah, and decided to pass the rest of his
life striving in the path of Allah.
Once he beheld the Prophet (Sallallaho 'Alaihe Wasallam)
in his dream saying to him...
'O, Bilal ! How is it that you never visit me ?'
No sooner did he get up than he set out for 'Madinah', and upon
reaching there, Hasan and Husain (Radhiyallaho Anhuma) ~
PROPHET ﷺ~ grandsons requested him to call out the 'Azan'.
He could not refuse them, for they were very dear to him.
But as soon as the 'Azan' was called, the people of Madinah
cried openly out of their anguish at the memory of the happy old
days of the Prophet (Sallallaho 'alaihe wasallam) time.
Even the women came out of their houses weeping...!
Bilal (Radhiyallaho Anhu) left Madinah again after a few days and
died in Damascus in 20 A.H.
Notes:
The great devotee and Muezzin of
PROPHET( SALLALLAHO 'ALAIHE WASALLAM)
the courageous and beloved Abyssinian by the name of
Bilal Habshi (Radhiyallaho Anhu) passed away in the middle of
reading the 'Azan' in Damascus, Syria between the years 638 and 642 (AD).
This was the second time after the death of
PROPHET( SALLALLAHO 'ALAIHE WASALLAM)
that BILAL~( Radhiyallaho Anhu) recited the Azan.

On Average 17 US Military Veterans Commit Suicide Every Day
[Couresy Stars and Stripes]
WASHINGTON — The Department of Veterans Affairs has
altered how it calculates the average number of veteran
suicides each day, meaning the 20-per-day statistic —
widely known and often cited by elected officials —
has changed to 17.
The VA released its annual National Veteran Suicide
Prevention Report on Friday, tracking the changes from year
to year. The 2019 report includes data from 2017, the most
recent available.
More veterans died by suicide in 2017 than the previous
year, the report shows. There were 6,139 veteran suicide
deaths in 2017, an increase of 129 from 2016.
However, the new report lists the daily average of veteran
suicides at 17, down from the 20 per day reported in
previous years. The VA explained that it removed
servicemembers, as well as former National Guard and Reserve
members who were never federally activated, from its
count.

Symbolic Opposition to the Dakota Access Pipeline [DAPL]
by Nadrat Siddique
I ran the 10.6 miles of the BWI Trail on February 9. It's a
trail I regularly run, but this run was special. This year
marks the 5-year anniversary of the heroic stance taken by
the Standing Rock Sioux and their allies to stop desecration
of Indian land by Big Oil, in particular the Dakota Access
Pipeline (DAPL).
Despite having ZERO legal standing, DAPL continues to
operate with impunity. So, the Standing Rock Youth Council
initiated a 93-mile relay to call attention to the
illegalities being carried out by the oil company.
Their statement on the action is here:

My run, like many others held around the country, was in
solidarity with the Standing Rock Youth Council action in
North Dakota that day. I wanted those courageous youth to
know they had Pakistani/ Muslim support.

Fear None but give everyone a Chance to Repent
by Imam Badi Ali
Asalamu alaikum,
When you believe that Allah stands with you, then it does
not matter who stands against you. Trust in Allah.
When Allah doesn't give you something you prayed for,
consider it a protection and blessing.
Allah knows everything, the unseen, the future. what is good
for you and what is bad for you.
Why worry? When everything is in control of Allah.
Oh Allah, please guide me to trust in your plans, for things
work out the way they should, and give me strength to
believe that. Ameen
Even after all the crimes Pharaoh committed against Allah
and the Children of Israel, Allah still commanded Moses to
speak kindly to him just in case he'd ask for forgiveness.
Whatever sin causes your despair, it does not compare to the
sins of Pharaoh.
Allah has an "open-door policy". There is no sin big enough
to make a person despair of Allah's Mercy.
No matter how big the sin, Allah's Mercy is bigger.
Oh Allah grant us hope, especially in our times of despair
and darkness. Ameen.
Israel Attempting to Steal More land, faces push back.

Israeli soldiers shot, Friday, a Palestinian with a gas bomb
in the head, and caused dozens to suffer the effects of
teargas inhalation, after the army attacks dozens of
residents on their lands, west of Salfit in central West Bank.
Media sources said the Palestinians gathered on lands Israel
intends to illegal annex in the al-Marahat and ar-Ras area,
and performed Friday prayers, before the soldiers assaulted them.
The Palestinians were also planting trees and preserving the
threatened lands in an activity organized by various
political factions, Salfit City Council, the Wall and
Colonization Resistance Commission, the Popular Resistance
Committees in addition to several local groups and societies.
The soldiers attacked the Palestinians with high-velocity
gas bombs, and concussion grenades, wounding one
Palestinian, who was shot with a gas bomb in the head, and
caused dozens to suffer the effects of teargas inhalation.
It is worth mentioning that Israel is planning to confiscate
50 dunams of private Palestinian lands, west of Salfit, to
establish a new colony, and the army has already uprooted
dozens of trees in the area.
In related news, a Palestinian man was seriously injured,
Friday, after several fanatic Israeli colonialist settlers
attacked him in Kufur Qalil village, south of the northern
West Bank city of Nablus.
Also on Friday, Israeli colonialist settlers assaulted and
injured two Palestinian women near the al-Fandaqumiya
village, northwest of Nablus, in northern West Bank.
In addition, a Palestinian man, identified as Bilal Shehada
Bawatna, 52, was killed, and two others were injured,
Friday, after being rammed by an illegal Israeli colonist's
car, while participating in a nature walk activity in the
Northern Plains of the occupied West Bank.
Extreme Oppression in Hindu Family and Canada's Inability to deliver Justice.
[Yahoo News February 12]
A B.C. woman who was sexually abused by an older cousin when
she was a child in the 1980s says she was crushed to learn
the province's highest court will allow him to remain a free
man, despite multiple convictions.
The B.C. Court of Appeal has upheld a lower court order
staying proceedings against Manjit Singh Virk, the man who
assaulted Jeeti Pooni beginning when she was just 11 years
old.
"One would think at some point that the system is going to
work for survivors," Pooni said of that decision.
"It was very disheartening, disappointing — you name
it — when one has spoken their truth, testified and
there's a guilty verdict, and then you receive this news."
Virk was convicted in 2018 of four criminal counts related
to the historical sexual abuse of three younger cousins.
But the proceedings were stayed when a B.C. Supreme Court
justice found that the seven-year delay from when Virk was
first charged until the end of the trial was unreasonable.
The Crown appealed, questioning the lower court judge's
calculations and decision to issue a stay after the trial
was complete, but the appeals court dismissed those
arguments on Wednesday.
Writing on behalf of a unanimous panel of five justices,
Justice Lauri Ann Fenlon expressed some discomfort with the
outcome.
"This is a troubling case. The charges were serious,
involving sexual abuse of vulnerable complainants. Mr. Virk
was found to be guilty of most of the offences charged," she
wrote.
"A stay of proceedings in these circumstances marks a
failure of the justice system."
The ruling stems from the landmark Jordan decision of 2016,
which sets a limit of 30 months for trials in superior
court. Beyond that deadline, any delay is presumed to be
unreasonable, apart from exceptional circumstances or
unnecessary delay caused by the defence.
In the Virk case, Fenlon noted that a large portion of the
delay was a result of "complacency and lack of urgency" by
Virk's original defense lawyer, but said the Crown
compounded those delays by failing "to take control of the
prosecution and move it along effectively."
