Letter to O'Reilly [Fox TV]

Serious Error about the Alleged Success of Water-boarding Torture in the case of Abu Zubaydah

Dear Mr. O'Reilly: [Re: Your December 11 program.] Your enthusiasm to prove the efficacy of water-boarding as a form of torture led you to bring forth an informant on the subject who was less than candid. Your informant said that Abu Zubaydah started talking within a minute after he was water-boarded. Your informant did not state what kind of information Abu Zubaydah provided.

He is a Palestinian Islamist who was 30 at the time of his arrest. President Bush himself was interested in the possibilities and extent of information which could be extracted from him. Ron Suskind in his groundbreaking book on the subject, The One Percent Doctrine, indicates very clearly, from expert, inside, witnesses, that the torture led Abu Zubaydah to provide "information" which was extremely misleading and damaging to the efforts of security within the U.S. The interrogators not only water-boarded him but threw their entire package of fear and intimidation at him. Unfortunately for the U.S. he was merely an organizer of transportation for Al-Qaida visitors and travelers and knew nothing of combat plans.

Here is what Suskind writes about the results of the torture:

"Under this duress, Zubaydah told them that shopping malls were targeted by Al-Qaeda....Agents from the FBI, Secret Services, Customs, and various related agencies joined local police to surround malls. Zubaydah said banks - yes, banks - were a priority. FBI agents led officers in a race to surround and secure banks. And also supermarkets - Al-Qaeda was planning to blow up crowded supermarkets, several at one time." [page 115]

And the list went on from Abu Zubaydah's fertile mind. Mr. O'Reilly I wonder if you remember those scares when every now and then the color code for fear of attack would brighten. It was all fake and the result of torture which led the victim to concoct stories because he believed he was going to die.

The Quest for Peace
USA Cannot Defeat Islam:
Understanding and the Principle of Self-Determination can Lead to Peace

Before we understand why the U.S. cannot win, [scroll down for answer], let's get some deadwood out of the way.
It's time for the U.S. to stop pretending that it is not waging war on Islam and that it considers Islam a "noble religion of peace." The ravaged and desecrated mosques of Iraq, Afghanistan, Pakistan and Palestine have made that pretense quite futile. Once the U.S. is willing to be honest and accept the fact that it is waging war on Islam, the quest for peace can begin.
Americans, in great numbers, already suspect that the U.S. government is not honest with them. Muslims here can take the initiative and tell Americans the following facts: Which are the OBSTACLES to peace? Is it not strange that with NOT ONE army willing to fight for Islam, America and Israel still can't win? Here is why:
  1. Islam is not a national entity confined to any one geographic boundary. Bush and his advisers/propagandists often claim that they will turn Iraqis and Afghans into tamed Muslims just like they turned their ferocious World War II enemies, Japanese and Germans, into abject and servile people who are often mere cheap imitations of Americans.
  2. America is not being opposed by national-secular forces in Iraq and Afghanistan but by Islamic forces imbued with values connected to belief in the Hereafter. The national-secular forces are in fact supporting the U.S.
  3. As the conflict continues, the support for resistance [Jihad], slowly but steadily escalates. If Islam is a lake, American bombs dropping in the lake, create bigger and bigger ripples, some of them huge waves. The bigger the bombs, the wider the ripples of resistance.
  4. When the WTC and the Pentagon were hit by 19 assailants using American planes, the Muslim world did not understand what had happened. The Muslim middle class came up with conspiracy theories [generated by Iranian TV al-Manar] about 9.11. Masses of Muslims demonstrated around the world in support of Osama when the U.S. bombed Afghanistan, particularly when the bombing was carried out during Ramadan, but these protests were not in support of the 9.11 attacks.
  5. Less than 1% of the Muslim world, according to some estimates, wanted to help Osama fight against America [although one percent is a very large number in a world population of 1.8 billion]. Six years later, the estimate of Muslims actually willing to fight America has risen to 10 %. Numbers of people supporting the fighters without trying to join are estimated at 44% in Pakistan and 6o% in "Saudi" Arabia. As for being against the American war on Muslims, the least hostile to America, Turkey, has 80 to 90% opposition, with 99% in Jordan [whose King is Bush's "buddy."]
  6. Islam is resurgent. Suppression will not work. The martyrdom of Husain, r.a., the grandson of the Prophet, pbuh, rejuvenated Islam for a thousand years. Today Shi'ite support for America often clouds the fact that the martyrdom concept is a rejuvenating element in the Islamic psyche, be it the martyrdom of Husain, r.a., or that of Abdullah ibn Zubair, r.a, or that of Umar, r.a, or that of Usman, r.a., or that of the first woman martyr, Sumayya, r.a. There is no such thing as a "suicide bomber." Muslims honor the martyrdom operators with the greatest honor because Allah has honored self-sacrifice. Psychological studies aimed at denigration of "suicide bombers," most of them coming out of Israeli think tanks, have not persuaded Muslims to dishonor the martyrs [though everyone deplores the civilian deaths which have occurred owing to the lack of accuracy and haste of the "suiciders" to go to Paradise.]
  7. Because Islam is resurgent, propaganda against Islam is bound to hurt Muslims, even the relatively secularized Muslims. The U.S., Israel and Britain have embarked on a disastrous course by attacking the martyrs of Islam as "suiciders" and the hijabi women as "victims" of male superiority. The Israeli propaganda springs from deep hatred of Islam. It should not have been used by the U.S. media. America has not gained anything by the constant attempts to denigrate fighters as "terrorists." Israelis and Americans in F-16s are shown as heroes of freedom and democracy while the oppressed and downtrodden sons and daughters of Islam, who turn their frail bodies into weapons are shown as "terrorists." Such dishonesty would be unthinkable by any standards of human valor.
  8. A very important Israeli value which the American power structure shares can be summed up in the phrase: BOMB THEM INTO THE STONE AGE. For the sake of peace, America should give up the Israeli idea that bombing will work. Even Saddam was not cowed down by bombing. With the forces of Islam, the threat is meaningless. Bombing usually destroys the infrastructure which is valuable for Muslim middle classes which, in most cases, are already allied to the U.S./Europe. If tomorrow, the U.S. and Israel were foolish enough to bomb Syria, Egypt or Iran, the Islamic resistance would increase to a level unheard of till now.
  9. If someone as wealthy and used to luxury as Osama and Ayman al-Zawahiri can move to the rugged terrain and the harsh climate of Afghanistan, what is to be gained by taking away the goods of the world from those who love the Other World.
  10. Stop trying to impose "democracy" on Muslims. The experiences of Palestinians in Gaza, the Algerians before them, and now the trickery of General Musharraf, have left Muslims with no illusions about American concepts of "democracy."
  11. The way to peace is connected to the principle of SELF-DETERMINATION. The Muslim world should have the right to rule itself on the basis of Islam. The U.S. should not be courting "leaders" who deny Islam's political power. In Hosni Mubarak's Egypt, Islam as a force in the socio-political system is denied, by the use of brute state terrorism, to a population which is more than 90% Muslim. The same is true of Turkey.
  12. If the American people realize that the U.S. is denying Islam to a people who want Islam, there could be greater understanding about the causes of conflict.

Hakim, who met with US President George W. Bush last week, said the newly released US intelligence report saying Iran halted its nuclear bomb program in 2003 would help the dialogue between the two foes. "I suppose that Iraq should host in the coming few days this fourth round of the dialogue. We are seeking to see a constructive dialogue," Hakim said at a news conference (...) In Their Own Words-Members of the IDF Speak

It is important for Americans to remember–and particularly these days when well-paid liars for Israel such as Normon Podhoretz, Daniel Pipes, David Horowitz et al are pushing the entire Western World into armed conflict with those in the Middle East–that the start of the whole affair between America and "terrorism" was not the rise of 'Islamo-fascism' that warmongers such as the aforenamed have labeled as being the cause of the problems.
Rather, it is the history–the well-documented and easily-verifiable history–of unspeakable violence that has been perpetrated everyday for the last century by those under the ungodly, inhuman spell known as Zionism against the peoples of the Middle East, Christian as well as Muslim, violence that rarely (if ever) gets a fair hearing in the Western media.
Those who make it their business to document and expose Israel's regularly-occurring viciousness against the peoples of Palestine, Lebanon and elsewhere are usually met with scoffs and contempt by a media in the West for the most part completely within the clutches of Zionist/Jewish interests. While the world is forced to hear about every instance–real or contrived–of someone from the Jewish community suffering a nose bleed or whose 'dignity has been offended' by some bigoted remark, at the same time the world is rarely afforded the opportunity of hearing about what takes place in the lives of innocent Arabs–men, women and children–who must suffer under the oppression of a foreign occupier that considers them 'grasshoppers' whose 'heads should be smashed against the wall', as one former Israeli prime minister once quipped.
A recent piece appearing in the Guardian of London sparked outrage in the Zionist Jewish community for its brutal frankness concerning the brutal behavior of Israel's soldiers, inaccurately named the 'IDF'–meaning Israeli Defense Forces' towards the Arabs who find themselves in the tragic position of being under their thumb. The piece in question detailed a series of interviews conducted by a psychologist at Hebrew University named Nufar Yishai-Karin with 21 members of the IDF.
As the reader will see, the members of Israel's military forces are not the 'most moral army in the world' as they are often called by the slavish, sycophant supporters of the political corporation based on gangster principles known as Israel. Rather, as the damning interviews indicate, being one of 'God's chosen soldiers' in Gaza and the West Bank means being tasked with the business of inflicting as much pain, suffering and humiliation upon the Christians and Muslims there as possible so as to eventually make them leave, resulting in the racially-pure 'Eretz Y'Israel' that Zionism demands. Reprinted below–in their own words–are the remarks of just a few members of the IDF describing what life is like for the Arabs living in the Occupied Territories, a mere smattering of the truth that Americans–and particularly American Christians–never read or hear about, neither from their news media nor their well-paid and over-fed preachers.

'The truth? When there is chaos, I like it. That's when I enjoy it. It's like a drug. If I don't go into Rafah, and if there isn't some kind of riot once in some weeks, I go nuts...'

'The most important thing is that it removes the burden of the law from you... You are the law...The moment you leave the place that is called Eretz Yisrael [the Land of Israel] and go through the Erez checkpoint into the Gaza Strip, you are the law. You are God...'

'We were in a weapons carrier when this guy, around 25, passed by in the street and, just like that, for no reason - he didn't throw a stone, did nothing - bang, a bullet in the stomach, we shot him in the stomach and the guy is dying on the pavement and we keep going, apathetic. No one gave him a second look...'

'With women I have no problem with violence...One threw a shoe at me and I kicked her here [pointing to the crotch], I broke everything there. She can't have children. Next time she won't throw shoes at me. When one of them spat at me, I gave her the rifle butt in the face. She doesn't spit anymore...'


Another instance recounted by the psychologist conducting the interviews described an occasion where the soldiers were escorting some arrested Palestinians. The arrested men had been taken from their beds in the middle of the night and were barely clothed, even though the temperature was below zero. The new recruits trampled on the Palestinians and then beat them for the whole of the journey. They opened the bus windows and poured water on the arrested men from their canteens.
As the testimonies prove, the brutality is not limited to grown men and women. In one instance, a soldier recounts something he witnessed while on patrol–

"It's 6am, Rafah is under curfew, there isn't so much as a dog in the streets. Only a little boy of four playing in the sand. He is building a castle in his yard. Our officer suddenly starts running and we all run with him. He grabs the boy and breaks his hand here at the wrist and his leg here. Then he started to stomp on his stomach, three times, and left...The next day I go out with him on another patrol, and the soldiers are already starting to do the same thing."

These short, small-in-number testimonies from 'Israel's finest' are but microscopic testimonies to a version of the truth that the world rarely hears, if ever, and despite the fact that they are things that have appeared more recently, what the world should remember is that it is but the tip of an iceberg that has existed for nearly a century now. And let not the world make the mistake of thinking that it is limited to the ramblings of a few nobodies in the IDF, when considering the words of Ariel Sharon, the Butcher of Beirut, war criminal and the monster that George Bush once referred to as a 'man of peace'–

"...I encourage my soldiers to rape Arabic girls, since the Palestinian woman is a slave for the Jews, and we do whatever we want to her and nobody tells us what we shall do but we tell others what they shall do..."

–or a diary entry from –'Moshe,' a Second Lieutenant in the Israeli army–

"...I took the Palestinian girl captive. On the first night the soldiers pack-raped her and the next day I saw fit to remove her from the world. I had the soldiers dig a shallow grave, and then I killed the 12 year-old girl with a burst from a sub-machine gun."

–or the remarks of Christopher Hedges, American journalist on assignment in Gaza–

"......The Israeli soldiers shoot with silencers. The bullets from the American M-16 rifles tumble end over end through the children's slight bodies. Later, in the hospital, I will see the destruction: the stomachs ripped out, the gaping holes in limbs and torsos. Yesterday at this spot the Israelis shot eight young men, six of who were under the age of eighteen. This afternoon they killed an eleven-year-old boy, Ali Murad, and seriously wound four more, three of who are under eighteen. Children have been shot in other conflicts I have covered, but never before have I watched as soldiers enticed children like mice into a trap and murdered them for sport."

And it is precisely this last thing, 'murdering people for sport' and sadism of the Zionists that is the reason for American men and women dying in Iraq and Afghanistan today and–barring some miracle–why they will be dying in Iran and Syria tomorrow.

[ Eid al-Adha is on the Tenth day of Dhul Hijja by the Sighted Moon This "Bid'ah" of fixing Eid al-Adha date by the Hajj date in Makka started in some Arab countries and Turkey not long ago on the assumption the Hajj/Arafah in Makka in on the 9th. Therefore, the next day would be the 10th all over the world.

Sheikh Baaz warned in an article that there is no valid "Daleel" to support that all the Muslims have to follow the Makka horizon for moon-sighting. Sheikh Uthaimeen urged the Muslims in North America to follow the sighting in North America for fixing the Eid al-Adha date. Just two years ago, the Shura Council, following ISNA Fiqh Council, confirmed that all the Ulema who were consulted in this matter said that they did not find any supporting argument in the Qur'an and the Sunnah for fixing Eid date by Hajj date.

Qur'an: (The Crescent moons) are the Mawaqeet... for (determining the date of) Hajj. (2:189). (Aayat 2:185, 2:200 and 22:29 have no relevance for determining the Hajj date.

The only correct date of Eid al-Adha all over the world is 10th Day of Dhul Hijja, counted from the evening Dhul Hijja hilaal is seen. It is well-known that NONE of the six committees in Saudi Arabia ever see the hilaal on the officially announced dates. It is always SEEN in Saudi Arabia a day later.)

Please try to ask these questions of any Alim who asks you to follow Saudi dates:


1. What are the 'Mawaqeet' for fixing the Islamic dates and for Hajj? (See Ayah 2:189)

a) The crescents (Ahilla)

b) The New Moon

c) Saudi Taqweem


2. What should the Muslims do when it is beyond any doubt that the Saudi dates are fixed against the Qu'anic directive?

a) Follow their actual sighting

b) Follow Saudi date even if wrong


(If the Muslims follow Saudi dates (Fast on Saudi 9th Dhul Hijja (local 8th ), and pray on Saudi 10th D. Hijja (local 9th ) then several complications arise.

1) What should the Muslims do on their actual 9th and 10th D. Hijja? What about their "Udhiya"? What day should they count as the day of "Nahr" locally?

If they do it according to the Saudi date they are doing it on actual 9th D.Hijja. A "sacrifice" made before the prayer on the 10th D. Hijja is not counted as fulfilling the obligatory "Udhiya." Another one has to be done. Obviously, any of the "Udhiya" done on the wrong Saudi date is on 9th D.Hijja according to the 'Miqaat' specified in the Qur'an.

2) Should we pray again on the actual 10th day of D. Hijja?

3) Is Eid al-Adha prayer made on local actual 9th (but Saudi 10th) valid?


Hadith: Eid al-Adha is on the 10th day of Dhul-Hijja

(All Ahadith mention only the 10th as the day of Eid al-Adha. No Hadith mentions: the day after Hajj or Eid al-Adha is a celebration of Hajj.) If Eid al-Adha was a celebration of the completion of Hajj then why did the Messenger (S) pray it regularly for 9 years when there was no Hajj for the Muslims?.

1. How did the Messenger (SAW) fix the day of "Nahr" in Medina?

a) By the sighted crescent wherever he was, or

b) By the day of Arafah in Makkah.


2. When did he (SAW) start Eid al-Adha prayer?

a) After Hajj was made obligatory in the 10th year, or

b) From the second year in Medina

(There was no Hajj for the first 8 years of the Messenger (SAW) living in Medina, but he and all Sahaba prayed Eid al-Adha from the second year.)


3. Did the Messenger (SAW) ever try to check Arafah/Nahr date in Makka or adjusted his dates accordingly?


4. Did any of the Khulafa al-Rashidun ever try to announce the dates of Arafah/Nahr in Makka to the Muslims living outside Makka so that they do not miss Hajj, Eid prayer and Sacrifice?

(In several instances, the Companions living outside Makka missed the Hajj when they reached Makka on the 9th day according to their sighting. The Hajj in Makka was over because of an earlier sighting in Makka.)


5. Did any of the Sahaba ever try to send the news of Hajj date to other towns or acted on the news?

(Umar bin Abdel Aziz used to alert the governors of various provinces about the dates of Ramadan ahead of time as mentioned in Ahadith.)


6. Did the Sahaba ever decide their Nahr/Prayer dates on the "news" from Makka or witnesses from another place if a crescent was not seen in their town? (Kuraib's famous Hadith clarifies this point well.)


Fiqh

1. Did any of the Fiqh Schools ever issue a ruling that the Muslims living outside Makka must/may fix their Eid al-Adha date by the Arafah day in Makka?

(To avoid chaos and dissension among the Hujjaj the Fuqaha agreed that the valid date of Arafah is when Dhul Hijja crescent moon was seen in Makka, and not when the Hujjaj saw it in their hometowns away from Makka. It was only to avoid Hajj on two or three days as it happens at Eid al-Fitr now all over the world. )


2. Is there any new "Dalil" now to tie Arafah/Nahr all over the world to 9-10th Dhul Hijja in Makka?

(If the day of Nahr in Makka is the determining factor then the countries east of Makka from Australia to Pakistan may have Eid prayer and sacrifice before the day of Nahr begins in Makka. Should they wait till next day?

The Muslims living west of Makka may often see a crescent moon a day ahead of when it is actually visible in Makka. Should they wait a day, in case Saudis ever start following the sighted crescent moon?)


3. Why is it not a 'Bid'ah,' and imposing an undue hardship on the Muslims scattered all over the globe?


Facts

The earth is a globe, not a flat field.

(The Moon cannot be visible all over the world at the same time.)

2. Once a crescent moon is first visible at any place, every place west of it (in a parabola) will see it. Most of the world will see it within 24 hours. (A "lunar" Islamic day/date).

3. The moon is first seen at a different place every month.

4. The Muslims living west of Makka will often see a crescent a day ahead of Makka.

5. A lunar day/date is always two solar days/dates as they are fixed differently. The solar date is fixed by the International Dateline in the Pacific Ocean and the day/date begins at mid-night locally. The Lunar dateline is fixed by the earliest visible crescent and the day/date locally begins after the sunset.

6. The Lunar dateline moves westwards every month.


Some More Questions

1. Why the Saudi Hajj, Ramadan and Eidain dates are always ahead of the rest of the world? In other words, how can they see a crescent moon before others who are living west of them?

2. Can a crescent moon be 'seen' before the conjunction (as the Saudi authorities announced for Ramadan and Eidain 1419, December 18, 1998, January 17, 1999 and March 17 1999)?

3. What if Saudi fixed date of Hajj makes our D. Q'ada only 28 days, and Dhul Hijja 31 days?

4. If the Saudi authorities ever start following the 'sighted' crescent for Dhul Hijja, should the Muslims in North America who will often see the D. Hijja crescent a day ahead of them wait till Dhul Hijja 11 for their Prayer/Nahr? The Muslims living in the east of Makka will face a reverse situation. Their 10th of Dhul Hijja may often be a day later than Makka. Should they adjust their dates according to Makka?

5. Not only prayer/Nahr will be affected by any such adjustment but the days of "Tashriq" as well.

The answer is very clear. The Muslims must follow the Qur'an, the Sunnah, and the consensus of the Ummah for the last 1400 years. The Qur'an specifies the crescent moons as determining the Islamic dates, and the Hajj. Saudi authorities fix the Islamic and Hajj dates by other than 'Ahilla', and therefore the Muslims must not follow them. We checked the books of Fiqh, and did not find any support for the assertion that Eid ul-Adha should be made on the basis of Hajj decision. The Hadith of the Prophet - peace be upon him - that al-Hajj yauma yahujju al-nas is for those who make Hajj. Of course those who go to Hajj must go to 'Arafah according to the decision of the authorities there, even if that is contrary to the astronomical data or someone's own moon sighting. But people in far away lands do not make Hajj in their locations. They have to make Eid prayer and make Qurbani. They cannot have Eid on 9th of Dhul Hijjah, if the moon was not sighted in their location and sighted in Arabia one day before. They cannot have Udhhiyaha a day earlier.

The answer to the question of Fasting on the Day of Arafah, as the respected Mufti from S. Arabia explains is very simple if we keep in mind a few basic facts:

1. The earth is a globe and not a flat field.

2. There is no reason that Dhul Hijja crescent moon (or any other month's moon) will ALWAYS BE FIRST SEEN in Saudi Arabia. A Crescent moon is first seen from a different place on earth every month.

3. Saudi Arabia decides about Islamic dates NOT BY THE HILAAL (the crescent moon that you first see after sunset) but by calculating: Moon is setting after sunset (even by a second).

Although the claim is always made that a "moon was seen at....(many places), by a large number of "Adil" witnesses in the kingdom" or 30 days of the month are completed.) Most Arab states just follow Saudi Arabia.

5. It is also a fact that if 30 days of the Islamic month are really complete then a moon will ALWAYS BE SEEN. If it is not seen on a clear sky, then 30 days are not complete.
